Terms of service

Overview

These Terms of Service ("Terms") apply when you use www.tharshana.com (the "Site") or buy from Tharshana Designer Wear ("Tharshana", "we", "us"). Orders shipped within the United States are sold by Tharshana USA Inc. All other orders are sold by Tharshana Designer Wear, Sri Lanka. By using the Site or placing an order, you agree to these Terms, together with our Privacy Policy, Refund Policy and Shipping Policy.

Using the Site

  • You agree not to misuse the Site, including by attempting to disrupt it, access it without permission, or use it for anything unlawful.
  • If you create an account, you're responsible for keeping your login secure and for activity on your account.

Products

  • Our pieces are hand-illustrated and printed, and some are handmade. Small variations in colour, print placement and finish are part of their character and aren't defects.
  • We try to show colours accurately, but how they appear depends on your screen.
  • Sizing information is a guide. Please check our Size Guide before ordering.
  • Products available to you may depend on your country.

Prices and payment

  • Prices are shown in the currency for your country (LKR in Sri Lanka, USD elsewhere). Prices in Sri Lanka include applicable taxes. In the United States, sales tax is added at checkout where applicable. For other countries, prices don't include import duties or taxes, which are paid by the recipient on delivery.
  • We may change prices at any time, but changes won't affect orders already placed.
  • If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full, even after it's been confirmed.
  • Payment is taken when you place your order, through the payment methods shown at checkout. Buy-now-pay-later services (such as Koko and Mintpay) are provided by those companies under their own terms.

Orders

  • Your order is an offer to buy. It's accepted when we dispatch it, or when we confirm it in writing.
  • We may refuse or cancel an order, for example if an item is out of stock, we suspect fraud, or we can't deliver to your address. If we cancel, we'll refund any payment in full.
  • Pre-orders are covered by our Pre Order Policy.

Shipping, returns and refunds

Delivery is covered by our Shipping Policy, and returns and refunds by our Refund Policy. Nothing in these Terms affects any rights you have as a consumer under the laws of your country.

Discounts and gift cards

  • Discount codes are subject to the terms shown with them, can't be exchanged for cash, and usually can't be combined unless stated.
  • Gift cards can be used on the Site, can't be exchanged for cash except where required by law, and aren't refundable.

Intellectual property

All designs, prints, illustrations, photographs, text and other content on the Site belong to Tharshana or its licensors and are protected by copyright and other laws. You may not copy, reproduce, sell or use them for commercial purposes without our written permission. Buying a product doesn't give you any rights to its design.

Reviews and content you share

If you submit a review, photo or other content, you confirm it's yours and accurate, and you give us permission to use, display and share it on the Site and our social media. We may remove content that's offensive, misleading or unlawful.

Limitation of liability

To the extent permitted by law, we aren't liable for indirect or consequential losses, and our total liability for any order is limited to the amount you paid for it. Nothing in these Terms limits liability that can't be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

Governing law

Orders shipped within the United States are governed by the laws of the State of Connecticut. All other orders and use of the Site are governed by the laws of Sri Lanka. If you're a consumer, you also keep any protections given by the mandatory laws of the country where you live.

Changes to these Terms

We may update these Terms from time to time. The version on the Site when you place an order applies to that order.
